Los Angeles (AP) - A 30 -year -old who appeared naked at 4 monthsbeneficiary
The lawsuit, presented by Spencer Elden on Tuesday in a federal court in California, claims that Nirvana and the labels behind "Nevermind" "intentionally marketed Spencer's child pornography and took advantage of the shocking nature of their image to promote themselves and theirmusic at his expense. ”
The demand says that Elden has suffered "life -for damage" for the omnipresent image of him naked underwater apparently swimming after a dollar ticket hanging from a hook.
Find at least $ 150,000 from each of the defendants, who are more than a dozen and include the heirs of Kurt Cobain, the surviving members of Nirvana Krist Novocelic and Dave Grohl, and Geffen Records.
Representatives of the defendants did not immediately respond electronic emails in search of statements.
Elden presents the lawsuit now because "he finally has the courage to hold these actors responsible," said one of his lawyers, Maggie Mabie, to The Associated Press on Wednesday.
Mabie pointed out that, although the photo is 30 years old, the demand is within the prescription period according to the Federal Law on Child Pornography for several reasons, including that the image is still in circulation and generates income.
Elden also wants the new versions of the album to be modified.
"If there is a relaunch for the 30th anniversary, he wants the entire world not to see his genitals," said Mabie.
When the cover photo was taken, Nirvana was a little -known grunge band and had no idea that he was creating an album that would define his generation with “Nevermind”, his first release with an important seal whose songs include “Smells Like TeenSpirit "," Come as you are "and" Lithium ".
Elden's father was a friend of the photographer, Kirk Weddle, who took photos of several babies swimming in several stages at the Rose Bowl Aquatic Center in Pasadena, California.
"Cobain chose the image that shows Spencer, like a sex worker, grabbing a dollar ticket that is placed with a hook in front of his bare body with an explicitly exposed penis," says the demand.
Elden has recreated the image several times, always with clothes or swimsuit, for the anniversaries of the album's launch, and has expressed feelings found in this regard in interviews that have become increasingly negative over the years.
In 2015 he told the New York Post that it was "great but strange to be part of something so important that I don't even remember."
"It would be nice to receive a 25 cents for each person who has seen my baby penis," he added.
The Associated Press does not usually identify people who say they have been victims of sexual abuse unless they are pronounced publicly, as is the case of Elden.
